1. Land Use and Zoning
1.1. ZONING ORDINANCES

The zoning district of our proposed photovoltaic locations, including the East Campus, City Campus, and agricultural field, is classified as a Public Use District [1].

Property owned and used by the government and put to public use is classified under this district. The only type of building or premises permitted in this district is one that is owned by any governmental entity. This does not include land in private ownership if leased to the governmental entity which is, in this case, the University of Nebraska-Lincoln [2].

1.2. ANALYSIS OF COMPLIANCE AND PROPOSED REZONING

To comply with these ordinances, TU Bright will be filing an appeal with the Board of Zoning Appeals to allow for our photovoltaic system to be constructed in this Public Use District [3]. The application for variance to the City of Lincoln will include: a site plan, proof of site control, a check for $412, and a letter stating the purpose of our application [4] [5]. The purpose is to allow for a private company to install photovoltaics in a Public District with approval from the governmental entity. Once we submit our application for variance, the Lincoln Board of Zoning Appeals will consider it approximately 30 days following submittal.
During the hearing, the Board of Zoning Appeals will ensure that the proposed change will not constitute a change in the district map, will not impair an adequate supply of light and air to adjacent property, will not increase the congestion in public streets, nor impair the public health, safety, comfort, morals, and welfare of the City of Lincoln [6]. By following all necessary codes, we will ensure that our photovoltaic system complies with these requirements. Therefore, it is probable that our zoning appeal will be approved which will allow us to move forward with construction.
